These Terms of Service apply to all purchases made through the online store Sacraia at www.sacraia.art.

By placing an order through this website, you agree to these Terms of Service. Your statutory rights as a consumer remain unaffected.

1. Scope

These Terms of Service apply to all contracts concluded between Sacraia, represented by Caroline-Marie Kreuzer, and customers through the Sacraia online store.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A business customer is any natural or legal person or partnership with legal capacity acting in the exercise of its commercial or independent professional activity.

Any conflicting terms submitted by a business customer will apply only if Sacraia has expressly agreed to them in writing.

2. Products and Original Artworks

Sacraia offers original artworks created by the artist Caroline-Marie Kreuzer. Unless expressly stated otherwise in the respective product description, each artwork is a unique, one-of-a-kind original.

The product photographs and descriptions are intended to represent each artwork as accurately as possible. However, colours may appear slightly different depending on the customer’s screen settings, lighting conditions, and device. Minor variations in colour display do not constitute a defect.

Original artworks may contain visible brushstrokes, paper textures, irregularities, artistic marks, or other characteristics resulting from the creative process. These are part of the individual nature of the artwork and do not constitute defects, provided that the artwork otherwise corresponds to its product description.

The dimensions, materials, condition, and other essential characteristics of each artwork are stated on the relevant product page.

3. Conclusion of the Contract

The presentation of products in the online store does not constitute a legally binding offer. It is an invitation for the customer to place an order.

The customer submits a binding offer to purchase the selected artwork by completing the checkout process and clicking the final order or payment button.

After the order has been placed, the customer will receive an automatic order confirmation by email. This confirms that the order has been received but does not necessarily constitute acceptance of the order.

The purchase contract is concluded when Sacraia expressly accepts the order, confirms shipment of the artwork, or dispatches the artwork, whichever occurs first.

Sacraia reserves the right to reject or cancel an order before acceptance, particularly if:

  • the artwork is no longer available;

  • an obvious pricing or product-description error has occurred;

  • payment could not be authorised or completed;

  • the shipping address is incomplete or cannot be served;

  • there is reasonable evidence of fraud, misuse, or an unauthorised transaction.

If payment has already been collected for an order that cannot be accepted, the amount paid will be refunded using the original payment method.

4. Availability of Original Artworks

Because each original artwork is unique, only one physical original of each artwork is available unless expressly stated otherwise.

In rare cases, an artwork may be sold through another channel shortly before the online inventory is updated. If an ordered artwork is no longer available, Sacraia will inform the customer promptly and refund any payment already received.

Sacraia is not required to provide a replacement artwork, as each original is unique. The customer’s statutory rights remain unaffected.

5. Prices, Taxes and Import Charges

All prices are displayed in the currency selected or shown in the online store.

The final price, applicable taxes, shipping costs, and any other charges collected by Sacraia will be displayed during checkout before the customer submits the order.

For deliveries outside the European Union, additional import duties, customs fees, local taxes, or handling charges may be imposed by the destination country. Unless expressly collected during checkout, these charges are not included in the purchase price or shipping costs and must be paid by the recipient.

Sacraia has no control over charges imposed by foreign customs or tax authorities. Customers are responsible for obtaining information about the import regulations and charges applicable in their country before placing an order.

6. Payment

The payment methods currently available are displayed during checkout and may include Shopify Payments, credit or debit cards, PayPal, and other payment methods offered through Shopify.

Payment processing may be carried out by third-party payment providers. Their additional terms and privacy policies may apply to the processing of the payment.

Unless otherwise stated during checkout, payment is due immediately when the order is placed.

The customer is responsible for providing complete and accurate billing and payment information. Sacraia may delay or cancel an order if payment cannot be authorised or if the information provided appears incomplete or inaccurate.

7. Shipping and Delivery

Orders are shipped to the delivery address provided by the customer during checkout. The customer is responsible for checking that the address is complete and correct before submitting the order.

Available destinations, shipping costs, and estimated delivery information are displayed during checkout or described in the Shipping Policy.

Any processing or delivery times provided are estimates unless a binding delivery date has been expressly agreed. Delays caused by customs procedures, postal services, carriers, severe weather, strikes, force majeure, or other circumstances outside Sacraia’s reasonable control may affect delivery.

For purchases made by consumers, the risk of accidental loss or damage generally passes to the customer when the customer, or a third party designated by the customer other than the carrier, receives the artwork.

This does not apply where the customer independently commissions a carrier who was not offered by Sacraia, subject to applicable law.

8. Retention of Title

The physical artwork remains the property of Sacraia until the purchase price and all applicable charges under the relevant order have been paid in full.

9. Inspection, Damage and Delivery Problems

Customers should inspect the package and artwork promptly after delivery.

If an artwork arrives damaged, defective, or different from the item ordered, the customer should contact Sacraia as soon as possible at hello@sacraia.art and, where possible, provide:

  • the order number;

  • a description of the issue;

  • photographs of the external packaging;

  • photographs of the shipping label;

  • photographs showing the damage or incorrect item.

This information helps Sacraia assess the issue and make any necessary claim against the carrier. Failure to report damage immediately does not remove any mandatory statutory rights available to consumers.

Customers should retain the artwork and all original packaging until Sacraia has provided further instructions.

If the delivered artwork is defective or damaged, Sacraia will bear the necessary return or replacement costs where required by applicable law.

10. Statutory Rights in the Event of Defects

The statutory rights relating to defective goods apply.

Where an artwork is defective, the customer may be entitled to the remedies provided by applicable law, including subsequent performance, a price reduction, withdrawal from the contract, or compensation where the relevant legal requirements are met.

Because each original artwork is unique, delivery of an identical replacement may be impossible. In such a case, another legally available remedy may apply.

Nothing in these Terms excludes or limits mandatory consumer warranty rights.

No additional commercial guarantee is provided unless it is expressly stated in writing for a particular artwork.

11. Right of Withdrawal and Returns

Consumers who purchase goods through the online store may have a statutory right to withdraw from the contract within 14 days without giving a reason.

Detailed information about the right of withdrawal, the withdrawal period, return costs, the return procedure, refunds, and the model withdrawal form is provided in the Refund Policy.

To exercise the right of withdrawal, the customer must send Sacraia a clear statement of the decision to withdraw within the applicable withdrawal period. Customers may use the cancellation function in their customer account, the model withdrawal form contained in the Refund Policy, or contact Sacraia at hello@sacraia.art.

The use of the model withdrawal form is optional.

The customer bears the direct cost of returning an artwork following a withdrawal, provided that the customer was informed of this obligation before placing the order. This does not apply to justified complaints concerning defective, damaged, or incorrectly delivered goods.

The right of withdrawal and the customer’s statutory rights are not excluded merely because an artwork was purchased at a reduced price or during a sale.

12. Refunds

Return transit times vary depending on the country from which an artwork is returned. No fixed estimate can therefore be provided for the total duration of an international return.

Once a returned artwork has been received, Sacraia will inspect its condition. Please allow approximately 3–5 business days for the inspection and internal processing.

After the inspection, Sacraia will notify the customer whether the return and refund have been approved. If approved, the refund will be initiated using the same payment method used for the original purchase unless expressly agreed otherwise.

If the artwork has been damaged, soiled, or otherwise diminished in value due to handling beyond what was necessary to inspect it, an appropriate deduction may be made where permitted by law.

For returns under a statutory right of withdrawal, all payments required by applicable law will be reimbursed. Additional delivery costs resulting from the customer’s choice of a delivery method other than the least expensive standard delivery method offered by Sacraia do not have to be reimbursed.

Where permitted by law, Sacraia may withhold reimbursement until the returned artwork has been received or the customer has provided evidence that it has been sent back, whichever occurs first.

Additional processing time required by the customer’s bank, card issuer, PayPal, or other payment provider is outside Sacraia’s control.

Mandatory statutory refund periods and consumer rights remain unaffected.

13. Copyright and Intellectual Property

The purchase of an original artwork transfers ownership of the physical artwork only. All copyrights, reproduction rights, exploitation rights, and other intellectual property rights relating to the artwork remain with the artist, Caroline-Marie Kreuzer, unless expressly agreed otherwise in writing.

The buyer may possess, privately display, lawfully publicly exhibit, and resell the physical original. However, the buyer may not reproduce, copy, publish, distribute, modify, create derivative works from, commercially exploit, or use the artwork or images of it for advertising, merchandise, prints, digital products, NFTs, or any other commercial purpose without the artist’s prior written permission.

Sacraia and the artist retain the right to photograph, reproduce, publish, and use images of the artwork—including after the physical original has been sold—for the Sacraia website, the artist’s portfolio, social media platforms such as Pinterest, exhibitions, publications, promotional materials, prints, licensing, and other artistic or commercial purposes.

The purchase price covers ownership of the physical original only. It does not include copyright, exclusive reproduction rights, or any other exclusive usage rights unless expressly agreed otherwise in writing.

14. Permitted Use of the Website

The content of the Sacraia website—including artwork images, photographs, text, graphics, logos, designs, videos, and other materials—is protected by copyright and other applicable intellectual property laws.

Website content may be viewed and used for personal, non-commercial purposes only.

Without prior written permission, users may not:

  • reproduce, download, republish, or distribute website content for commercial purposes;

  • use artwork images to manufacture or sell products;

  • remove copyright notices, signatures, watermarks, or other rights information;

  • use website content to train, develop, or operate artificial-intelligence systems or datasets;

  • falsely claim authorship or ownership of an artwork or image;

  • use the website or its content in an unlawful, fraudulent, or harmful manner.

Sharing a link to a publicly available Sacraia webpage through ordinary social-media functions is permitted, provided that the content is not altered and the artist is not misrepresented.

15. Customer Content and Communications

If a customer submits photographs, reviews, messages, or other content to Sacraia, the customer confirms that they are authorised to submit that content and that it does not infringe the rights of another person.

Submitting content privately for customer-service purposes does not grant Sacraia the right to publish it publicly.

Sacraia will request permission before using identifiable customer reviews, photographs, or similar customer-provided content for public marketing, unless the content was deliberately posted publicly and may lawfully be shared under the applicable platform’s functions and terms.

16. Liability

Sacraia is liable without limitation:

  • for damage caused intentionally or through gross negligence;

  • for injury to life, body, or health;

  • under applicable product-liability law;

  • where Sacraia has fraudulently concealed a defect;

  • where Sacraia has expressly provided a guarantee.

In cases of ordinary negligence, Sacraia is liable for breaches of essential contractual obligations whose performance is necessary for the proper fulfilment of the contract and on which the customer may normally rely. In such cases, liability is limited to the foreseeable damage typical for this type of contract.

Any further liability for ordinary negligence is excluded to the extent permitted by law.

These limitations do not restrict mandatory statutory rights or claims.

17. Events Beyond Reasonable Control

Sacraia is not responsible for a delay or failure to perform caused by circumstances outside its reasonable control, including natural disasters, severe weather, war, civil unrest, government measures, customs delays, strikes, transport disruptions, power failures, or failures of essential third-party services.

This provision does not affect the customer’s mandatory statutory rights, including any right to withdraw from or terminate the contract where the legal requirements are met.

18. Privacy and Data Protection

Personal data is processed in accordance with the Sacraia Privacy Policy and applicable data-protection law.

The Privacy Policy explains, among other things, how personal data is collected and used in connection with orders, payments, shipping, customer accounts, website analytics, marketing, cookies, and third-party service providers.

19. Changes to These Terms

Sacraia may update these Terms of Service for future transactions where necessary, for example because of changes to the website, available services, business processes, or applicable law.

The version displayed at the time the customer places an order applies to that order. Changes made after the conclusion of a contract will not retroactively alter that contract unless required by law or expressly agreed by both parties.

20. Contract Language and Storage

The contract language is English.

Sacraia may store the contractual information and order details in accordance with applicable legal retention obligations. Customers should save or print the order confirmation, these Terms of Service, and the applicable policies for their records.

Depending on the customer-account functions available through Shopify, customers may also be able to view information about their orders through their account.

21. Governing Law

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law does not deprive them of mandatory protections provided by the law of the country in which they have their habitual residence where those protections would otherwise apply.

22. Place of Jurisdiction

The statutory rules regarding jurisdiction apply to consumers.

For contracts with merchants, legal entities under public law, or special funds under public law, the courts at Sacraia’s registered place of business will have jurisdiction to the extent permitted by law.

23. Consumer Dispute Resolution

Sacraia is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration body.

The former European Online Dispute Resolution platform has been discontinued and is therefore not linked on this website.

24. Severability

If any provision of these Terms of Service is or becomes wholly or partially invalid or unenforceable, the validity of the remaining provisions will not be affected.

The relevant statutory provision will apply in place of the invalid or unenforceable provision.
