Terms & Conditions

1. Scope and seller

These Terms & Conditions apply to purchases of physical goods from Sacraia.

The seller’s identity and contact details are provided in the Legal Notice.

Mandatory consumer rights remain unaffected by these terms.

2. Products

The product page describes the item’s dimensions, materials, price and other relevant characteristics.

If an artwork is a one-of-a-kind original, it is signed and accompanied by a Certificate of Authenticity.

Original artworks are supplied unframed unless expressly stated otherwise.

Colors and shimmer may appear different depending on lighting, viewing angle, photography and screen settings. This does not limit your rights if goods do not conform to their description.

3. Placing an order and conclusion of the contract

Before placing an order, you can review your selection and correct the information entered during checkout.

By submitting an order using the final payment-obligation button, you make a binding offer to purchase the selected goods.

We accept your offer through our order confirmation. The contract is concluded when that confirmation reaches you.

The contract language is English. You may save or print these terms before ordering. Your order details and the applicable contractual information are provided by email.

4. Prices

Prices are displayed in euros and include applicable VAT.

Worldwide shipping is included unless expressly stated otherwise on the product page or during checkout.

Customs duties, import taxes and other destination-country import and clearance charges are payable by the buyer.

5. Payment

The payment methods available for your order are displayed during checkout. These may include bank transfer, credit or debit card, Apple Pay and Google Pay.

Bank transfer

Full payment must reach our account within three bank business days after you receive the order confirmation and payment instructions. The ordered goods are reserved during this period.

Please use the payment reference provided in your order information.

If an international transfer is expected to take longer, contact us before the payment deadline so that we can agree on an extension.

If payment is overdue, we may request payment and set an additional deadline where required by law before terminating the contract and releasing the reservation.

Card payments, Apple Pay and Google Pay

Payments are processed through WooPayments and its payment partners. The availability of individual payment methods may depend on your device, location and the payment provider.

Follow the instructions displayed during checkout to authorize your payment.

Orders are dispatched only after successful payment has been confirmed.

6. Dispatch and delivery

Processing takes 1–3 business days after full payment has been received.

Orders are dispatched worldwide with DHL Express unless a different arrangement is expressly stated for the relevant product.

Estimated delivery is 3–10 business days after receipt of full payment, including processing and transit. This is an estimate, not a guaranteed delivery period. Customs clearance, destination and other circumstances may affect delivery times.

Further information is provided in Shipping & Returns. Statutory delivery rights remain unaffected.

For consumer purchases, the risk of accidental loss or damage generally remains with us until you, or a third party designated by you other than the carrier, receive the goods. Statutory exceptions apply.

7. Retention of title

The goods remain our property until full payment has been received.

8. Copyright and reproduction rights

Purchasing an artwork transfers ownership of the physical item. It does not transfer copyright, reproduction rights or other intellectual property rights unless expressly agreed in writing.

Copyright remains with the artist. The artist may reproduce the artwork, create prints or other products featuring it, publish images of it and license its use.

The description “one-of-a-kind original” refers to the original physical artwork. It does not grant exclusive rights to its image or prevent future reproductions.

Any rights of use granted by law remain unaffected.

9. Withdrawal

Consumers entitled to a statutory right of withdrawal may exercise it under the conditions set out in the Withdrawal Policy.

The online withdrawal function is also available. Its use is optional.

10. Statutory rights concerning defects

Statutory rights concerning faulty or non-conforming goods apply.

Consumers in the EU generally benefit from at least two years of statutory legal guarantee protection from delivery. Longer mandatory protection periods may apply under the law applicable to the purchase.

Available remedies depend on applicable law and the circumstances. An identical replacement may not be possible for a one-of-a-kind original.

11. Applicable law

German law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.

If you are a consumer, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law that would otherwise apply, including the law of your country of habitual residence where applicable.
